We were a little late to the ceremony but what i saw of it was nice.

Here are the videos I took (sorry the sound sucks) the first three were uploaded to youtube before the reception moved past that awkward first stage wifi at reception, video taken on my palm centro and moved to my nokia n800 via bluetooth and uploaded from there. The last one I uploaded as soon as I got home.

Wimax? More like pain in my ass

Last night I bought a "residential wimax modem" a local ISP is doing their broadband over wimax (so they dont have to run copper) and are offering it for 35USD a month. That's all well and good but I can't get the bloody thing working in Linux, or for that matter Vista (tried on the girlfriends laptop and still couldn't get it to work, but I wasn't trying that hard)

So here are some pics to better explain whats going on.

Here is the modem the only interface out of this box is the ethernet cord, which should just make this this thing a basic wired connection.

Sexy box right? Well like i said earlier I can't get the bloody thing to work. Here is a brain dump of the problems and what I've tried:

* I get an IP its in the 10 range so it may not be routable (whatever not worried about that)
* /etc/resolv.conf shows namesservers as 205.171.3.65 and 205.171.2.65
* i cant ping the 205. nameservers
* changing to OpenDNS doesnt help
* every renew resets /etc/resolv.conf
* I've been running sudo dhclient eth0 to get a new ip thats when /etc/resolv.conf resets

What am I missing? Why is this such a pain!!!! I have a support ticket in, but they support Windows 98SE or higher and Mac OSX

Tried to Flash my n800 to Diablo, Tried Is the Operative Word

Woots! I fail hard! I tried to flash my n800 and failed miserably. I started out following this http://www.internettablettalk.com/forums/showpost.php?p=94459&postcount=2
and it fails at the second command on number 14 with a "sutable usb device not found" error http://linuxcranks.pastebin.com/m1c5b5cc8

Then thelastknowngod showed me this http://wiki.maemo.org/Updating_the_tablet_firmware and it fails with this error "Write failed after 0 bytes
usb_bulk_write: Resource temporarily unavailable"

AHHHHHHHHHHH!!!!!!!!

So now I am sitting here with a fairly useless n800. It still boots but it wont load an OS, so I still have hope, but man am I pissed.

**EDIT: I got this to work, but I had to use my girlfriends vista (puke) box, but the flasher for windows is niiice.

Printing in Crunchbang

I just got me a new HP DeskJet 6940 for my birthday. Its networked so I just stuck it on my network and started configuring boxen. My girlfriend's Vista laptop was bloody simple to set up (weird yeah I know). Then I got started on my computers (my desktop and my eee) which was where the problem started. Now mind you I had been drinking (me and the captain made it happen [mom bought the booze]). On said desktop and eee I am running CrunchBang Linux and cruncheee respectively (this will be important later).

On CrunchBang

If you right click and go to "Printer Configuration" it opens and a whole bunch of it is greyed out (wtf) but there is a fix:

step 1: sudo su

this will make you proper root, this is just to save time sudo-ing over and over again is a pain in the ass

step 2: cd into /etc/cups/ssl/

step 2.5: if you ls you will see server.crt and server.key, believe it or not just rm both of them

step 3: then run sudo /etc/init.d/cups start (i think you might not need this dont remember)

step 4: open "Printer Configuration" again and

step 5: POW that MF is working so set your stuff up

on CrunchEEE

This is not a problem some how it works in crunchbang for the eee [facepalm] wtf

it was this time last year.The next time I see it it will be a year from now but I must say that I can't think of a better reason to be up after 1.5 hours of

My rEEEview of the Asus Eeepc 900

Ok im a a week or so into my ownership of the Asus Eeepc and I think that I can now give a fair review. Because I'm a giant nerd the first thing I had to do is get rid of Xandros. Xandros is a huge pie o shit. This has nothing to do with the patient agreement with Micrsoft they have, this is solely about software... its shit. Nothing was intuitive, it seemed like there was a hodgepodge of software and none of it was integrated. So I tried to install eeebuntu. Tried is the operative word, the version of ubnetbootin was borked, and after a day of hacking on it, i had gotten nowhere and I was at work and had no net access so I was stuck trying to get
that download working. Once i got home i decided to try ubuntu-eee and OMFG is it great the older and better version of ubnetbootin was preconfigured for the ubuntu-eee hardy image and installed first try, NO ISSUES!!!!! Everything but the SD card slot works. Wifi,
webcam, sleep, power saving, all of it, so eff an SD card slot. You can see screenshots at http://www.unixporn.com/screenshots/thumbnails.php?album=5

And now on to hardware I got the 8.9 inch eeepc 900 with a 900 MHz Intel Celeron processor, 16 gb sshd, and 1gb of ram. this thing is awesome!! the keyboard is a bit of a pain in the ass. but i am getting used to it. these keys are tiny, but that isn't the real problem. the real issue is all of the non letter keys (tab, enter, backspace) are smaller than the letter keys. that drives me nuts! but again i am getting used to it. i really don't know what else to say this thing is tiny and pretty powerful. I could have gotten this with a 1.n GHz Inttel atom processor but I don't feel like i am missing anything 900mgz is more than enough

This person must agree with me that the last thing that Linux needs is more non-free software. I have no issue with making a comercial app but I think that it is immoral to create proprietary software. This is an age old spat but about 4 months ago I called "Merlyn" a wanker and he has now proved my point.

Dave Yates and some other Linux Podcasters are creating a planet to aggregate all of the Linux Podcasters blogs. This whole thing has been built in a mailing list. Because of this project I have proof that Merlyn is a wanker. Here was his one and only reply to the list.

I'm getting a "you have mail" notice from this thread about every five minutes
for the past 4 hours. I don't think that's necessary any more. Please remove

Trying for an all Free computer

Recently I decided that I should try a little harder to not have any non-free packages on my computers. So I installed Gobuntu which is as Canonical describes as:

Gobuntu is a GNU/Linux operating system, derived from Ubuntu, that endeavors to adhere to the Free Software Foundation's four freedoms and intends to provide a base for other free software platforms to build upon with minimal modification required. It does this by only including open-source non-restricted software. This means there will be no firmware, drivers, applications, or content included in Gobuntu that does not include the full source or whose license does not provide the right to use, study, modify, and redistribute the body of work.

and on my laptop has worked out great. I have an all centrino setup so all of the drivers are free. The only non-free packages I have installed are FireFox and Flash. Before any one gets a going here is what the FSF has to say about the Mozilla Public License:

Mozilla Public License (MPL)

This is a free software license which is not a strong copyleft; unlike the X11 license, it has some complex restrictions that make it incompatible with the GNU GPL. That is, a module covered by the GPL and a module covered by the MPL cannot legally be linked together. We urge you not to use the MPL for this reason.

However, MPL 1.1 has a provision (section 13) that allows a program (or parts of it) to offer a choice of another license as well. If part of a program allows the GNU GPL as an alternate choice, or any other GPL-compatible license as an alternate choice, that part of the program has a GPL-compatible license.

So if you don't wanna count that then the only non-free software I have on there is Flash.

The same is true for my desktop excluding one giant pain in the ass... the nVidia GLX driver. I must say that this is a point of sadness for me. The only bloody thing (other than Flash) that keeps me from total software freedom is driver... ahhhhhhhhhhhhhhhhhhhhhhhhH! With the nv driver I was stuck with the ultra high resolution of 800x600, which is not gonna work, I lived with it for a week and just can't do it. ATi is releasing documentation in the next 6 months or so, and once a free-driver is out from that, i will be making the purchase of a new graphics card. Good job nVida fscked again!!!

There are soooooo many Twitter clones and Twitter-esque apps/websites out there, but they all seem too fall short and I know why. Simplicity. I'd really like to pick on FriendFeed and Jaiku. Yes, they are "better" technologies. But have you tried to use them on a mobile? Well in FriendFeed's case, nope not possible (as far as I know), and Jaiku's case most of us haven't you must have a Nokia phone to do so. Welp my Palm Centro puts me out on that.

Here is my real issue... how in the hell are you supposed to use a threaded system through SMS? Oh yeah you can't!

Why is SMS soo important? How much time do you spend on the computer? How much of the day is your mobile in you pocket? For me the mobile wins EVERY DAY.

oh and one more thing Twitter is EASY!!! @username makes a whole lot of sense... this message is "AT" that username.

The immense popularity of sites like YouTube has unexpectedly turned Flash Video (FLV) into one of the de facto standards for Internet video. The proliferation of sites using FLV has been a boon for remix culture, as creators made their own versions of posted videos. And thus far there has been no widespread DRM standard for Flash or Flash Video formats; indeed, most sites that use these formats simply serve standalone, unencrypted files via ordinary web servers.

Now Adobe, which controls Flash and Flash Video, is trying to change that with the introduction of DRM restrictions in version 9 of its Flash Player and version 3 of its Flash Media Server software. Instead of an ordinary web download, these programs can use a proprietary, secret Adobe protocol to talk to each other, encrypting the communication and locking out non-Adobe software players and video tools. We imagine that Adobe has no illusions that this will stop copyright infringement -- any more than dozens of other DRM systems have done so -- but the introduction of encryption does give Adobe and its customers a powerful new legal weapon against competitors and ordinary users through the Digital Millennium Copyright Act (DMCA).

Recall that the DMCA sets out a blanket ban on tools that help "circumvent" any DRM system (as well as the act of circumvention itself). When Flash Video files are simply hosted on a web site with no encryption, it's unlikely that tools to download, edit, or remix them are illegal. But when encryption enters the picture, entertainment companies argue that fair use is no excuse; Adobe, or customers using Flash Media Server 3, can try to shut down users who break the encryption without having to prove that the users are doing anything copyright-infringing. Even if users aren't targeted directly, technology developers may be threatened and the technologies the users need driven underground.

Users may also have to upgrade their Flash Player software (and open source alternatives like Gnash, which has been making rapid progress, may be unable to play the encrypted streams at all). Third-party software that can download Flash Video, like the most recent RealPlayer, will also break. But Adobe now has an incentive to push the use of DRM: it's only available to sites that use Flash Media Server 3 software, which starts at over $4,000 (with extra fees depending on the number of simultaneous streams).

Furthermore, the prospect of widespread adoption of DRM restrictions on Flash threatens to squash a growing tradition of expressive fair use of online video -- a practice effectively in its infancy that, left unfettered, would be a dynamic solution to our failing effort to teach media literacy. Before we understand how to read media messages, we must first learn how to speak their language -- and we learn that language by playing with and remixing the efforts of others. DRM, by restricting the remixing of Flash videos, stands to bankrupt a rich store of educational value by foreclosing the ability of students and teachers to "echo others" by remixing videos posted online.

Take the example of "A Vision of Students Today" vs. "(Re)Visions of Students Today". The first "Vision" YouTube video is an artful critique of higher education's failure to come up with new models of instruction that engage the modern student; the second "(Re)Vision" YouTube video is an incisive observation of higher education's crisis in diversity (summarily expressed by the lack of diversity in the original "Vision" video). The original and the remix support each other to instruct with an influence above and beyond the power of either video alone.

Outside the halls of academia, we can see that the ability to openly download and remix video is part of a new ecosystem of amateur entertainment -- watch Drama Prairie Dog and its countless responses:

* "Hollywood Zombies Dramatic Prarire Dog"
* "Dramatic Look Bond Remix"
* Drama Prairie Dog - Zoolander
* "Drama Prairie Dog -- Kill Bill"
* (an obligatory Star Wars-related remix) "Darthmatic Chipmunk"

As we noted above, remixers who find and use tools that break the Flash Video encryption could be sued, even if their transformative creations would otherwise have been fair use.

Finally, there's a classic suite of arguments against DRM that will be as true for online video as they were for music. DRM doesn't move additional product. DRM is grief for honest end-users. And there's no reason to imagine that new DRM systems will stop copyright infringement any more effectively than previous systems.

Aaron sez, "The state of South Carolina has decided to put a freeway through my Grandfather's 150 year old house (built by HIS Grandfather). The Governor and the people in the planning office say the route my father worked out is fine, but they need 'public outcry' to justify moving it so if people 10 miles down the route ask why they moved it for us they can say 'hey, lots of people got pissed.' So I set up a petition which in mid-Feb. will send the results to the Governor's office and I need as many people to sign it as possible. They don't care WHO you are or WHERE you are, just so long as there is 'public outcry.'"

The home was built from trees that were cleared from the forests that now are open fields of fertile farmlands. The underpinning of the home was and still is hand-hewn logs held together by 10" wooden pegs. The original structure consisted of four equally sized rooms and the kitchen was separated from the home in the back to save the home in case of a fire in the kitchen.

In the late 1940's, the kitchen was joined to the rear of the home and three other rooms were added across the back of the house. The floors of this section were not joined evenly, and there is an approximate ten inch step down from the original section of the home to this rear section. The porch was also extended across the front and down the West side of the house. In 1957, my father, who was actually born in the home in 1916, remodeled the home, leaving the basic four rooms of the home but installing oak hardwood floors. He also left most of the original windows in rooms and by the front door, which were hand-blown glass with "wavy" imperfections and bubbles. The chimney on the East side of the house is also original which, according to family lore, has brick laid with "salt crete". It was covered with a thin layer of concrete years ago to protect it from weathering. Around 1965, dormers were added to the roof of the house and the attic was opened to house two bedrooms. And the final remodeling occurred around 1985 when the kitchen was remodeled and a carport was attached at the kitchen entrance.

Thats right kids the THE COLUMBUS DISPATCH is reporting that the flood in Downtown Columbus was a waterline and that's "... estimated that the damage to walls, carpeting and other fixtures will run into millions of dollars."

"The waterline, which runs down Swan Street and provides water to the west side of High Street, had been capped under the northern section of the convention center at 400 N. High St. The cap blew off for an unknown reason, and water shooting under the center pushed up the concrete slabs that make up the floor and flooded the center. When the water was turned off, the slabs subsided, leaving damaged drywall and doors that no longer line up with their jambs in the northern part of the center."

Creative Commons, some Vids and my project.

Minimo DOES work on Nokia's n770

Me and a buddy of mine (twitter: @sysnerd) were hacking on my n770 trying to get minimo running. The issue was this...

* You install it from the apt frontend (can't remember what is called)
* it installs in the extra menu
* you go to run it and it does nothing

Now here is the issue... The run script is a bash script but they have it trying to run as a c shell. This will not work, it's like a Frenchmen trying to explain string theory to a deaf German, not good.

To fix this you have to

* have xterm (its in the apt frontend)
* cd to /usr/bin/
* open a text editor, we used vi
* and edit the top line of the script to read #bash/usr/bin
* save and close

This is probablynot news to anyone but the RIAA hates you. Arstechnica is reporting today that 'Those MP3 and AAC files that you've ripped from your CD collection are still "unauthorized copies" in the eyes of the recording industry. In a brief filed late last week, the RIAA said that the MP3 files on a PC owned by a file-sharing defendant who had admitted to ripping them himself were "unauthorized copies." ' HUH? you mean the disc that I bought that contained no User Agreement, and no copy protection was not really mine. So that means when I was in high school and had $500 worth the CDs stolen out of my car, that they should have replaced them for me. Well I'd like to speak to a manager please.

"When asked by the RIAA's lead counsel whether it was wrong for consumers to make copies of CDs they have purchased, Jennifer Pariser replied in the negative. "When an individual makes a copy of a song for himself, I suppose we can say he stole a song," said Pariser. Making "a copy" of a song you own is just "a nice way of saying 'steals just one copy'," according to Pariser." OMG your bastards.

The line I like best is "I suppose we can say he stole a song" IF your going to call us thieves, then do it, but don't patronize us.

Freedom Hater of the Day: Nokia

ARSTechnica posted today that Nokia is upset with the W3C (World Wide Web Consortium) because they want to include both OGG Vorbis and Therora in the HTML5 Spec.

Why I Didn't I hear about this sooner? OGG on the web w00000000000000tzzz!!!!111one.

But Nokia had a List of issues, I answered this list of on Digg and figured that you all should see it too.

So with out Further adieu, My Rebuttal: A Rope of Sand:

1. W3C shouldn't make any standards relating to codecs. Leave that to other standards bodies like ITU-T and ISO/IEC.

*But the W3C is the standards body for the web not ITU-T and ISO/IEC, those 2 have no "jurisdiction" (I guess that word will do)

2. There are over a billion PCs in the world today, many connected to the web, but these numbers are tiny compared to traditional video playback devices like DVD players.

*DVD players have nothing to do with the web.

3. This industry is used to paying license fees and royalties for video codecs like MPEG-2.

* yeah and I'm sure they would be heartbroken to save money

4. This industry is used to making money, and it doesn't care about keeping things free.

*Free Software refers to freedom, not money. Think Free Speech, not Free Beer.

5. Web codec standards should be either free or low-cost to implement.

*see number 3

6. Web codec standards should support DRM to placate Hollywood, but DRM implementations should be optional.

*there hasn't been DRM on the Web so far (that I know of), and if they wanted to, the spec is in the Public Domian http://www.vorbis.com/faq/

7. H.264 for video and AAC for audio would be Nokia's recommendations for codecs.

*what in the hell do they have against Linux. If you standardize on those two the web will suck for Free Software fans for at least the next two years. x.264 is fairly stable and complete, but I don't about AAC

I remember this time last year and the search for James Kim. I remember hearing all of his close friends and colleagues in their attempts to cover the story without bursting into tears. I remember sitting on the bus (in tears) at the obvious pain that everyone was going through. I remember watching James on TechTV and was glad to see him working at CNET after TechTV was disbanded. And to hear of his passing is a heavy on the hearts of all tech lovers.

DMCA idiocy slideshow: explaining the DMCA to info-civilians

Wellington Grey has a great little slideshow about the idiocy of the DMCA's "anti-circumvention" measures, which prohibit breaking the digital locks off the stuff you own. In it, Grey recounts how offended he was when he bought a TomTom GPS that came with a CD in a sealed envelope, the seal on which read, "By breaking this seal, you agree to our contract," but the contract itself was on the CD, behind the seal. In other words, the CD said, "By breaking this seal, you agree to a bunch of secret stuff."

DRM and trying to explain it to those who have no clue

A couple of moths ago I was stopped by a wal*martian who was asking about the sticker that was on my iPod. The sticker reads "WARNING DRM Product restricts usage or invades privacy. DefectiveByDesign.org". I had no idea how to explain it to them. I stumbled through with a terrible example and left briskly feeling like a loser, and ultimately a failure.

How do you describe DRM? That's like going give me a definition of Evil, or what is air? So I started looking for talking points or some help on educating people. And I have to say that I came up fairly dry.

I think I'm okay arguing with people who know about it and are just on the wrong side, but when it comes to the unwashed masses I have no clue. I really wish someone like Cory Doctorow would write a "how to teach the unteachable about evil and DRM" (Cory feel free to use that title;) )

5 easy steps to a romantic evening

Tonight I set up a fairly nice dinner for my girlfriend, it was a kinda spur-of-the-moment type of thing. So I figured that I would give everyone the benefit of what I learned.

Step 1: Clean up

Not take a shower you wanker, she really doesn't care if you a days grime on you. (note any more than one day does require a bath) but clean up the immediate area around where you will eat. Anyone that knows me in meatspace knows that my place is a constant wreak. One good thing about a messy house is a clean spot looks like an oasis.

Step 2: Candles

Candles will make that clean spot more of an oasis. Just turn off all the lights and she'll just gravitate to it

Step 3: Food

Food is the least of your issues. Any food will do, my last romantic evening (the one being discussed here) was honey buffalo wings and steak fries. Not a big deal.

Step 4: Wine

Vino is not necessary but hell get her drunk. Even bad wine will do. I had my first just off the shelf buy a bottle, take it home, and hope is doesn't taste like ass. Well that didn't go so well you can read my review of the wine at cork'd (friend me up!)

Step 5: Music

Music is another easy one, just join last.fm. With that you don't have to own shite for music. Here is what I did. I went to last.fm and just played any music tagged "jazz", you can choose music by artist, genre, or just what it was tagged (so web 2.0!). And it worked there was even this Nora Jones track that we both dugg. (BTW friend me up here also)

Girlfriend v7.0 vs. Wife v1.0

I found this joke , and thought it was pretty funny the only problem was that it was written for a Windows/Non-Free audience. So I re-tooled it to be Free Software friendly. I also tried to make it more bug-report-esqe, so here is.

Last year I upgraded from Girlfriend 7.0.5.3 to Wife 1.0. I soon noticed that the new program began unexpected child processing that took up a lot of space, swap, and other valuable resources.

In addition, Wife 1.0 installed itself into all other programs and now monitors all other system activity. Applications such as Poker Night 10.3.6 , Football 5.0.42 , Hunting and Fishing 7.5.9.4 , and Racing 3.6.5

I can’t seem to keep Wife 1.0 in the background while attempting to run my favorite applications. I’m thinking about going back to Girlfriend 7.0.5.3 , but the shell script to uninstall doesn’t work on Wife 1.0 . Please help!

This is a very common problem that men complain about.

Many people upgrade from Girlfriend 7.0.5.3 to Wife 1.0, thinking that it is just a Utilities and Entertainment program. Wife 1.0 is an OPERATING SYSTEM and is designed by the contributors to run EVERYTHING !!! It is also impossible to delete Wife 1.0 and to return to Girlfriend 7.0.5.3 . It is impossible to uninstall, or purge the program files from the system once installed.

You cannot go back to Girlfriend 7.0.5.3 because Wife 1.0 is designed to not allow this. Try running "man Wife 1.0" and looking under Warnings-Alimony/Child Support . I recommend that you keep Wife 1.0 and work on improving the situation. I suggest compiling the plug-in "Yes Dear" to alleviate software augmentation.

The best course of action is to enter the command "sh /usr/bin/apologize.sh" because ultimately you will have to give the APOLOGIZE command before the system will return to normal anyway.

Wife 1.0 is a great project, but it tends to be very high maintenance. Wife 1.0 comes with several support programs, such as Clean and Sweep 3.2.7 , Cook It 1.5.6b and Do Bills 4.2.8 .

However, be very careful how you use these programs. Improper use will cause the system to launch the program Nag 9.5.2. Once this happens, the only way to improve the performance of Wife 1.0 is to compile additional software. I recommend Flowers 2.1.5 and Diamonds 5.0 !

WARNING!!! DO NOT, under any circumstances, install Secretary With Short Skirt 3.3 . This package is not supported by Wife 1.0 and will cause irreversible damage to the operating system!

Ok assuming that François sent this to Steve it's ballsy, a little weeny but ballsy. After I repost his letter for you all to read, I'll rewrite it to reflect what I would have said.

Dear Steve,

Hi, this is François, from Mandriva.

I’m sure we’re way too small for you to know me. You know, we’re one of these tiny Linux company working hard for our place on the market. We produce a Linux Distro, Mandriva Linux. The last edition, Mandriva 2008 was seen as a pretty good version and we’re proud of it. You should give it a spin, I’m sure you’d like it. We also happen to be one of the Linux companies that did not sign an agreement with your company (nobody’s perfect).

We recently closed a deal with the Nigerian Government. Maybe you heard about it, Steve. They were looking for an affordable hardware+software solution for their schools. The initial batch was 17,000 machines. We had a good answer to their need: the Classmate PC from Intel, with a customized Mandriva Linux solution. We presented the solution to the local government, they liked the machine, they liked our system, they liked what we offered them, the fact that it was open, that we could customize it for their country and so on.

Then your people entered the game and the deal got more competitive. I would not say it got dirty, but someone could have said that. They fought and fought the deal, but still the customer was happy to get CMPC and Mandriva.

So we closed the deal, we got the order, we qualified the software, we got the machine shipped. In other word, we did our job. I understand the machine are being delivered right now.

And then, today, we hear from the customer a totally different story: “we shall pay for the Mandriva Software as agreed, but we shall replace it by Windows afterward.”

Wow! I’m impressed, Steve! What have you done for these guys to change their mind like this? It’s pretty clear to me, and it will be clear to everyone. How do you call what you just did Steve, in the place where you live? In my place, they give it various names, I’m sure you know them.

Hey Steve, how do you feel looking at yourself in the mirror in the morning?

Of course, I will keep fighting this one and the next one, and the next one. You have the money, the power, and maybe we have a different sense of ethics you and I, but I believe that hard work, good technology and ethics can win too.

Schools need to be free to share and help others. What are they supposed to tell those children, "you need to share your toys, snacks, etc., but don't share software because if you do you are going to be sued." Great message dickwad.

OSI Approves Microsoft License Submissions

The OSI Board today approved the Microsoft Public License (Ms-PL) and the Microsoft Reciprocal License (Ms-RL). The decision to approve was informed by the overwhelming (though not unanimous) consensus from the open source community that these licenses satisfied the 10 criteria of the Open Source definition, and should therefore be approved.

The formal evaluation of these licenses began in August and the discussion of these licenses was vigorous and thorough. The community raised questions that Microsoft (and others) answered; they raised issues that, when germane to the licenses in question, Microsoft addressed. Microsoft came to the OSI and submitted their licenses according to the published policies and procedures that dozens of other parties have followed over the years. Microsoft didn't ask for special treatment, and didn't receive any. In spite of recent negative interactions between Microsoft and the open source community, the spirit of the dialogue was constructive and we hope that carries forward to a constructive outcome as well.

The Open Source Initiative is best known as the steward of the Open Source Definition and for its license review process. But, an open source license is just the starting point. Open source depends upon code (which can be made better), community (which can be made larger), and ultimately a commitment to the idea that the more free the market is for innovation, the more innovation the market can deliver.

Every approval that OSI issues represents our community's demand for more open-source code, a larger and more vital open-source community, and all the benefits open source brings to innovation in a free market. The new Ms-PL and Ms-RL are no exceptions.

From what I have read from these licenses they seem to be very forward thinking for Microsoft. I'm no sure how this will keep Steve "Monkey-Boy" Balmer from running his trap about Linux and other FOSS projects but maybe this can be a new era for Microsoft. I plan to keep microsuck.com in the bookmarks just in case though

Patent holding company IP Innovation has filed a patent infringement suit against Linux distributors Novell and Red Hat. The patent, which describes a "user interface with multiple workspaces for sharing display system objects," dates back to 1987 and originated in Xerox's PARC labs.

IP Innovation seeks damages and injunctive relief. "Red Hat's and Novell's infringement, contributory infringement and inducement to infringe has injured Plaintiffs and Plaintiffs are entitled to recover damages adequate to compensate them for such infringement, but in no event less than a reasonable royalty," reads the complaint.

The Linux vendors aren't the only companies that have been on the receiving end of lawsuits for allegedly infringing this particular user interface patent. In April, IP Innovation sued Apple and demanded $20 million in damages. Apple eventually settled with the company for an undisclosed amount.

IP Innovation, which is a subsidiary of the Acacia Research Corporation, develops no products of its own. Acacia owns over 140 patents in 38 separate categories, accumulating patents and generating all of its revenue from licensing and litigation. Such companies are generally referred to as "patent trolls" because the manner in which they take advantage of the patent system is broadly considered detrimental to innovation.

Many companies that invest heavily in Linux development have long anticipated patent threats against the operating system, but the defensive measures in place might not be enough to stop this threat. Consider, for instance, the Open Invention Network (OIN), which was originally devised to deter patent litigation by establishing a vehicle for severe retaliation. As critics of the OIN have pointed out in the past, a defensive patent portfolio doesn't provide protection from companies that do not develop products because there is no basis on which to sue them. The OIN's powerful patent portfolio cannot be used to force IP Innovation into a cross-licensing agreement because IP Innovation has no need to license the patents held by others.

I just sent a lengthy email into the Debian bug tracking system. I originally tried to send it directly to the developers through an already "closed" bug (which was returned undeliverable) so I sent it again to submit@bugs.debian.org. I sent it with the proper headings (I hope) so that it would get to the developers. the subject was "VRMS-Why is the Tango Icon theme listed as non-free", and the project in question is vrms or (Virtual Richard M. Stallman) which is a program that will analyze the set of currently-installed packages on a Debian-based system, and report all of the packages from the non-free tree which are currently installed. I think that it is a little unfair to call something non-free that is licensed under such a free license. The CC-attribution, share alike is almost exactly the GPL. The only issue I see is there is no source code for an image, but you are given the freedom to "remix" it as you like. There is nothing stopping you from retaining all of your freedoms, and the FSF itself says that it's okay for art and icon are art, so please remove this from the list.

Well Mousekateers I have a funny and uplifting story about how direct action and graffiti was used for the public good. I have been a graffiti artist for quite a while and I believe that it can be a powerful way to send a message. Let me tell you a story...

About a month ago a gas station that I frequent removed the condom machines from the bathroom. Knowing that the last thing we needed was to make it harder or embarrassing to get condoms I wrote in black permanent marker "WTF no condoms, well I guess I'll go and spread AIDS then". Well I went back in there tonight and there is a big poster sized advert for Durex that said something along the lines of "We're there when you need us." Score one for Graffiti

My brother and I were discussing Software Freedom, well I was being a zealot and he was being somewhat intelligent in his discussion. After this discussion I got a message on facebook telling me to install a thing called vrms. So I did. For those of you who don't know,

vrms (Virtual Richard M. Stallman) is a program that will analyze the set of currently-installed packages on a Debian-based system, and report all of the packages from the non-free tree which are currently installed.

Note that vrms is not limited to Debian systems only (which means that it also works with Debian-derived distributions such as Ubuntu). It is also not limited to Linux-based systems.

Future versions of vrms will include an option to also display text from the public writings of RMS and others that explain why use of each of the installed non-free packages might cause moral issues for some in the Free Software community. This functionality is not yet included.

Gutsy Countdown

This is really exciting and really scary at the same time. GNOME 2.20 is sweet there is no doubt about that, but the rest of the stuff is really buggy. Here is a list of stuff that has happened in no particular order:

*the bottom bar doesn't show up when you first boot
*the added effects manager or the other effects crash the system
*everything seems really touchy

I know not a "definitive list of why it shouldn't ship", but I'm still worried. Not for the people like me who are going to install it regardless and say that it's better than having to run Slackware from 6 years ago, but it's not even as ready as the Feisty Alphas were. I'm running the Beta and it's like Microsoft beta quality not Free Software Beta quality.

I'm also working on my thoughts of Ohio Linux Fest 2007 and hope to have that posted soon

State dept. won't say why UK music scholar is barred from US

Nalini Ghuman, a UK-born music professor at Mills College in Oakland, can't return to her home in the US, because the State Department revoked her visa and won't tell her or anyone else why.

In a written account of the next eight hours that she prepared for her lawyer, Ms. Ghuman said that officers tore up her H-1B visa, which was valid through May 2008, defaced her British passport, and seemed suspicious of everything from her music cassettes to the fact that she had listed Welsh as a language she speaks. A redacted government report about the episode obtained by her lawyer under the Freedom of Information Act erroneously described her as “Hispanic.”

Held incommunicado in a room in the airport, she was groped during a body search, she said, and was warned that if she moved, she would be considered to be attacking her armed female searcher. I was listening to the most recent Distrowatch OGGcast http://distrowatch.com/podcast/dww20070910.mp3
and the host brought up an interesting question, why does Ubuntu win all of the polls? Well here are my reasons why the next top competitors aren't on top.

Suse (SLED and OpenSUSE): No one trusts Novell. People tend to switch to Linux to get away from Microsoft, so why use a partner's distro?!?

Mandriva: I think Mandrivia is just crap, they focus way too much on the "club" (the tossers that actually pay for it) and don't focus enough on community building.

Debian: scary server OS

Fedora: I don't like Fedora. Okay scratch that, I hate RPM (RedHat Package Manager) . All Fedora needs is a new package manager (how about apt) and it would be fine. I would still reformat and put Ubuntu on, but Fedora may survive the first day.

Gentoo and Slackware: will never win because they are too damn difficult.

Mint Linux: may win the poll but will never come from the OEM because of the non-free codecs and shit they add (some illegally)

PCLinuxOS: name, the name sucks

This happened in a speed trap town in Missouri called St. George with only a few officers that think they have more power than they really ... do. This happened outside of their jurisdiction and they have no police powers where they stopped me.

The commuter lot is open 24 hours a day and can be confirmed by calling 1-888-Ask-MoDOT.

You'll hear this officer tell me he'll make up "9 different charges" including resisting arrest before he has even tried to arrest me. You'll hear him say how I didn't use my turn signal and I was weaving when the video clearly proves him wrong.

I truly thought if I didn't suck up, I would be beaten and maybe killed.
